Article 1 — Purpose

These Terms of Service govern access to and use of the HelloSocials service, a SaaS platform for scheduling and automatically publishing posts to social networks, published by Hello Factory.

Any use of the service implies full and unreserved acceptance of these Terms.

Article 2 — Access to the service

The service is accessible by registering at hellosocials.fr. Access requires creating an account with a valid email address.

A 7-day free trial is offered with no credit card required. Beyond that, access is subject to a paid subscription.

Article 3 — User account

The user is responsible for the confidentiality of their credentials. They agree to:

  • Provide accurate information at registration
  • Maintain the security of their password
  • Notify HelloSocials immediately of any unauthorised access
  • Not share their account with third parties

Article 4 — Subscriptions and payments

HelloSocials offers three pricing plans (Starter, Pro, Enterprise) billed monthly. Prices are stated inclusive of applicable taxes.

  • Payment is processed via Stripe, a PCI-DSS certified provider
  • Subscriptions renew automatically each month
  • Cancellation can be done at any time from the user dashboard
  • No refund is granted for the current billing period

Article 5 — Use of the service

The user agrees to use the service in compliance with the rules of third-party social networks (Instagram, LinkedIn, Twitter/X, Pinterest) and not to:

  • Publish unlawful, defamatory or rights-infringing content
  • Use the service for spam or harassment
  • Attempt to circumvent technical limitations of the service
  • Resell access to third parties without authorisation

Article 6 — Service availability

HelloSocials strives to ensure maximum service availability (99.5% SLA target for the Enterprise plan). Scheduled maintenance may be carried out with prior notice.

HelloSocials cannot be held responsible for outages caused by third-party APIs (social networks) or force majeure events.

Article 7 — Intellectual property

The user retains ownership of all content they publish via HelloSocials. By using the service, they grant Hello Factory a limited, non-exclusive licence to process and transmit that content to the relevant social networks.

Article 8 — Data protection

The processing of personal data is described in our Privacy Policy. Hello Factory acts as data controller within the meaning of the GDPR.

Article 9 — Limitation of liability

HelloSocials is a scheduling tool. Hello Factory's liability is limited to direct damages and may not exceed the amounts paid by the user over the preceding 3 months.

Article 10 — Termination

Hello Factory reserves the right to suspend or terminate an account in the event of a breach of these Terms, without prior notice or refund.

The user may cancel their subscription at any time from their account settings.

Article 11 — Changes to these Terms

Hello Factory reserves the right to modify these Terms at any time. Users will be notified by email with 30 days' notice for material changes.

Article 12 — Governing law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the courts of Paris shall have jurisdiction.
